Desde la perspectiva de los antecedentes hist ricos de la definici n de los derechos fundamentales, los constructos categ ricos que fungieron como principios y valores axiol gicos de la revoluci n mercantilista de los EE.UU., la "aproximaci n" m s cercana a lo que, el Estado Constitucional proclama y define como "derecho-fundamental", se ala Schmitt, fue emitida por el Estado de Virginia en 12 de junio de 1776, sigui ndole Pensylvania (11 de noviembre de 1776) y otros, y posteriormente incorporados como Amendments en 1789-1791).
