Estas acciones conservatorias son las llamadas acci n oblicua, subrogatoria o indirecta; la acci n Pauliana, llamada tambi n acci n revocatoria o de fraude y la acci n por simulaci n. Sabemos que el deudor responde con su patrimonio del cumplimiento de su obligaci n, ya que su patrimonio es la garant a del cr dito del acreedor, tal como lo dispone el art culo 1.864 del C digo Civil, y que este patrimonio est formado no s lo por los bienes y derechos que el deudor tenga en un momento dado, sino tambi n por los que en el futuro entren a formar parte de su patrimonio (art culo 1.863 del C digo Civil). Por lo tanto, el acreedor tiene un marcado inter s en la conservaci n del patrimonio de su deudor, pues mientras ese patrimonio se conserve, mientras aumente, mayor garant a tendr el acreedor de ser satisfecho en su respectiva acreencia. El legislador, para proteger este leg timo inter s del acreedor, confiere determinados derechos y acciones destinados a impedir que un deudor doloso (o culposo, negligente o imprudente) sustraiga, oculte, enajene o disipe ese patrimonio y disminuya o haga desaparecer as las garant as de su cr dito.
